ARTICLE 1: General Terms and Conditions
By making an appointment with us, in person, by telephone, by email, or via the website, you agree to the General Terms and Conditions below. These terms and conditions apply to every offer, treatment, and transaction between House of Beauty Eindhoven (us) and you as the client, unless you and we expressly deviate from these terms and conditions in writing.
ARTICLE 2: Treatment
We will perform treatments to the best of our knowledge and ability and in accordance with the requirements of a reputable professional. We have a best efforts obligation and do not agree with you on any obligation to achieve results.
You will ensure that we receive all information that may reasonably be relevant to the proper execution of the treatment in a timely manner so that we can take this into account during the treatment.
We work in accordance with the hygiene rules of the HAM Code and NEN-EN 17169. Clients are expected to adhere to personal hygiene guidelines.
We process your personal data and treatment details on a (digital) client card, which is then stored in a client database. We treat your data confidentially in accordance with the GDPR. We will not sell or transfer your data to third parties without your written consent, unless this involves a transfer of business.
ARTICLE 3: Prices and Payment
All our prices include 21% VAT.
We display our treatment and product prices in the salon and/or on the House of Beauty Eindhoven website.
Offers issued by us are valid for the duration specified by us and/or while supplies last.
Payment for the treatment may be requested in advance if multiple treatments are scheduled, or immediately after the treatment. Payment must be made immediately in cash or by bank transfer.
ARTICLE 4. Unavailability, Lateness, or No-Show
If you are unable to attend an appointment, you must notify us as soon as possible, but no later than 48 hours prior to the appointment, by email, phone, or WhatsApp.
If you fail to do so or do not do so on time, we will be forced to charge €15.00 per 15 minutes. This is because we incur costs to hold the appointment for you, and we will then be unable to treat another client at the agreed-upon time, resulting in a loss of profit.
If you arrive more than five minutes late, we may deduct the lost time from the time allocated for the appointment.
ARTICLE 5: Liability
We are not liable for any damage of any nature arising from our reliance on incorrect and/or unverified or incomplete information provided by you regarding relevant physical conditions, medication use, work, or leisure activities.
We are not liable for the loss, theft, or damage to any personal belongings you bring to us.
If we are liable for your (bodily) injury, our liability is limited to the maximum amount paid out under our professional liability insurance in the event of damage.
ARTICLE 6: Reporting Complaints
If you have a complaint about a treatment performed by us or a product supplied to you, you must report the complaint to us both verbally and in writing as soon as possible, but within five days of discovery.
If a complaint about the treatments is justified, we will perform the treatment again as agreed, unless this has become pointless for you and you notify us of this in writing.
If a complaint about a product supplied to you is justified, we will refund the purchase price of the delivered product, in full or in part, at our discretion.
ARTICLE 7: Warranty
You receive a five-day warranty on a performed treatment. This warranty expires if you:
Have not followed our advice, including:
Used products other than those recommended by us;
Have not received advice for home care;
Have received advice to seek medical help;
How to use products.
The statutory warranty period applies to products purchased by you, unless it is excluded in relation to the product you purchased.
ARTICLE 8: Damage, Vandalism, and Theft
We reserve the right to recover damages from you if you damage equipment, furniture, or products. In the event of theft or vandalism, we will always report it to the police, and you will always be required to pay a fine of €150.00 in addition to the compensation for the stolen or damaged goods.
ARTICLE 9: Conduct
You are expected to conduct yourself according to generally accepted standards. If you fail to do so after repeated warnings from us, we reserve the right to deny you access to House of Beauty Eindhoven without further explanation.
ARTICLE 10: Gift Vouchers
A gift voucher issued by us cannot be exchanged for cash.
A gift voucher issued by us must be redeemed within one year; otherwise, it will no longer be valid.
ARTICLE 10: Law
Dutch law applies to every agreement between you and us.
